1. Who we are
Blogoogst is based in Nijmegen and registered with the Dutch Chamber of Commerce under number 92206735. You can reach us at info@blogoogst.com and on +31 6 13 13 70 44.
2. What these terms cover
These terms apply to every Blogoogst plan and to everything we do for you under it. You agree to them the moment you complete an order. If we agree otherwise on any point, we put that in writing.
We supply businesses and sole traders, not consumers. The statutory right of withdrawal for consumers therefore does not apply.
3. What you get from us
Whichever plan you choose, we research your market, propose blog topics every week, write the blogs you approve and publish them on your website. Exactly what your plan includes is set out on the pricing page; that description forms part of these terms.
We do our utmost to improve your visibility, but we cannot guarantee rankings, visitor numbers or revenue. Google and AI search engines decide for themselves what they show, and they change that regularly. Figures and examples on our website are illustrations, not promises.
4. What we need from you
To be able to deliver, we need access to your website and to your measurement data. You make sure that access is there and stays there. If you do not provide it, or provide it late, delivery moves back and the plan simply continues.
You are responsible for what you approve. A blog only goes live once you have given the go-ahead; from that moment the text is your publication.
5. Prices and payment
All amounts are in euros and exclude VAT. A monthly plan is collected in advance each month, a yearly plan once a year in advance. You give permission for the direct debit when you order. Every collection comes with an invoice by email.
On a yearly plan you pay 10 months for 12. The same discount applies to any add-ons you take with a yearly plan.
If a collection fails, we try again and contact you. If payment does not follow, we may suspend delivery until the amount has been paid.
We may adjust our prices. We announce any price change at least a month in advance; if you do not agree with it, you can cancel as of the date it takes effect.
6. Term and cancellation
Monthly plan. This runs by the month. You cancel by email or by phone, at the latest on the last day of the current month; the plan then ends at the end of that month and the direct debit stops with it. There is no minimum term and no cancellation fee.
Yearly plan. This runs for twelve months and then renews for another year each time, unless you cancel at least a month before the end of the current year. Cancelling part-way is not possible; the amount paid in advance is not refunded in that case. Switching from a monthly to a yearly plan is always possible.
We may also end the plan, with one month's notice, or immediately if you do not keep to these terms.
7. Who owns the content
Once you have paid the invoices for a period, the blogs delivered in that period are yours. You may keep them, change them and go on using them, including after the plan ends.
The software, the analyses and the way of working behind Blogoogst remain ours. You get a right to use them for as long as your plan runs.
8. Liability
If something goes wrong that is demonstrably our fault, we compensate the direct damage up to the amount you paid us over the three months before it. Consequential loss, lost revenue and loss of data fall outside this. This limit does not apply in the case of intent or deliberate recklessness on our part.
We are not liable for the consequences of changes at Google, at AI search engines, at your hosting provider or in your CMS.
9. Personal data
How we handle personal data is set out in our privacy policy. Where we process data on your behalf, we will enter into a data processing agreement at your request.
10. Complaints and disputes
If you have a complaint, email or call us; we would rather sort it out together. If we cannot, Dutch law applies and we put the dispute to the competent court in the district of Gelderland.
11. Changes
We may amend these terms. We will let you know about any change at least a month in advance. If you do not agree with it, you can cancel as of the date it takes effect.
